These terms and conditions govern your use of the Buddy that allows you to create and join events with other users who share your interests. By using Buddy, you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, please do not use Buddy.

 

License

 

Developer grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use Buddy solely for your personal, non-commercial purposes strictly in accordance with these terms and conditions.

Restrictions

 

You agree not to, and you will not permit others to:

 

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit Buddy or make Buddy available to any third party.

• Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of Buddy.

• Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of developer or its affiliates, partners, suppliers or the licensors of Buddy.

• Use Buddy in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms and conditions.

• Use Buddy to harass, abuse, defame, threaten, or violate the rights of any other user or third party.

• Use Buddy to create or join events that are illegal, immoral, offensive, or harmful to others.

• Use Buddy to transmit or upload any material that contains viruses, trojan horses, worms, time bombs, cancelbots or any other harmful programs.

Modifications

 

developer reserves the right to modify, suspend or discontinue, temporarily or permanently, Buddy or any service to which it connects, with or without notice and without liability to you.

Term and Termination

 

These terms and conditions shall remain in effect until terminated by you or the developer.

 

Developer may terminate your use of Buddy at any time without notice if you breach any of these terms and conditions.

 

Upon termination of these terms and conditions:

 

• You must cease all use of Buddy and delete all copies of Buddy from your device.

• All rights granted to you under these terms and conditions will also terminate.

• Any provisions of these terms and conditions that by their nature should survive termination shall survive termination.

Disclaimer of Warranties

 

Buddy is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, developer expressly disclaims all warranties whether express, implied or statutory with respect to Buddy including but not limited to any warranties of merchantability fitness for a particular purpose title non-infringement and quiet enjoyment and warranties arising out of course of dealing usage or trade.

 

Developer does not warrant that:

 

• Buddy will meet your requirements;

• The operation of Buddy will be uninterrupted error-free secure or virus-free;

• The results that may be obtained from the use of Buddy will be accurate or reliable;

• Any errors or defects in Buddy will be corrected.

 

You acknowledge and agree that:

 

• You assume all responsibility for selecting Buddy to achieve your intended results;

• You assume all risk for any damage to your device or loss of data that results from the use of Buddy;

• Developer has no obligation to provide any support maintenance updates, enhancements or modifications to Buddy.

Limitation of Liability

 

To the maximum extent permitted by applicable law in no event shall developer be liable for any special incidental indirect consequential punitive exemplary or other damages whatsoever including but not limited to damages for loss of profits loss of data loss of goodwill corruption of data failure to transmit or receive data business interruption personal injury property damage bodily injury emotional distress loss of privacy loss of use loss of opportunity loss of savings loss of reputation arising out of or in any way related to the use of or inability to use Buddy regardless of the cause of action whether based on contract tort negligence strict liability statute product liability breach of warranty or otherwise even if developer has been advised of the possibility of such damages.

 

In no event shall developer's total liability to you for all damages exceed the amount actually paid by you for Buddy.

 

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages so some of the above limitations may not apply to you. In such jurisdictions developer's liability shall be limited to the greatest extent permitted by law.

Indemnification

 

You agree to indemnify, defend and hold harmless developer and its affiliates partners suppliers and licensors from and against any and all claims actions demands losses liabilities damages costs and expenses including but not limited to reasonable attorney's fees arising out of or in connection with your use of Buddy or your breach of these terms and conditions.

Governing Law

 

These terms and conditions shall be governed by and construed in accordance with the laws of Turkey without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts of Turkey for any dispute arising out of or relating to these terms and conditions.

Severability

 

If any provision of these terms and conditions is held to be invalid or unenforceable by a court of competent jurisdiction such provision shall be modified to the extent necessary to make it enforceable and the remaining provisions shall remain in full force and effect.

Waiver

 

No failure or delay by developer in exercising any right power or remedy under these terms and conditions shall operate as a waiver of any such right power or remedy.

Entire Agreement

 

These terms and conditions constitute the entire agreement between you and developer with respect to Buddy and supersede all prior or contemporaneous understandings and agreements whether written or oral with respect to Buddy.
